Processing of personal data – information under the General Data Protection Regulation (2016/679/EG)
AG Advokat is the data controller in respect of the personal data we process when providing legal services, including the preparation, performance and administration of assignments from our clients. AG Advokat is also the data controller in respect to all personal data we process in our contact with our suppliers.
What types of personal data we process about you depend on the situation, but we mainly process name, identification information, contact information and information about any position you may have within a company or other legal entity. If necessary, we may also process other types of personal data about you, for example when performing an Anti-Money Laundering check.
We process the personal data for the following purposes:
- Making sure that we do not have a conflict of interest when providing our legal services.
- Performance of Anti-Money Laundering checks.
- Performance and administration of legal assignments from our clients.
- Protection and promotion of our clients’ interests.
- Accounting and invoicing.
- Communication.
The legal basis for the abovementioned processing of personal data is the performance of a contract, the fulfilment of a legal obligation or the legitimate interest of AG Advokat or our client to process personal data in certain situations when the legitimate interest of AG Advokat or our client outweighs any interest you might have in us not processing your data.
You are under no obligation to provide us with your personal data, but if you refrain from doing so we cannot provide you with legal services as we are unable both to perform an Anti-Money Laundering check as well as making sure that there is no conflict of interest.
The personal data may be used for the development of our business, market analysis, statistics and risk-management, as well as for marketing and events organized by AG Advokat. Personal data used for the development and analysis of our business are processed based on our legitimate interest to develop our business and communicate with our contacts.
Please contact us in case you require more information regarding the legal basis used to process your personal data or regarding how we justify processing of your personal data based on a legitimate interest.
Personal data may be transferred between different companies within the AG Advokat group for us to perform Anti-Money Laundering checks, to make sure that there is no conflict of interest, to share knowledge and to allocate resources. We will not transfer personal data to others unless (i) you have agreed to the transfer, (ii) the transfer is necessary for us to protect or promote the interest of a client, (iii) the transfer is necessary for us to fulfil a legal obligation or comply with a decision from a court or a public authority, or (iv) we hire an external contractor who provide a service for us. If necessary to protect the interests of our clients, the personal data may also be transferred to courts, public authorities, counterparties and their representatives.
The personal data is stored, pursuant to our obligation under Code of Conduct issued by the Swedish Bar Association, for ten years after the relevant assignment has been finalized. The data can be stored for a longer period if required given the nature of the assignment in relation to which the data are processed. Data used to develop, analyze and market our business are stored for three years from the time of our last contact with you. Should you unsubscribe to our newsletter or similar communication from us, your data are erased immediately.
You have the right to, without any charge, obtain information about what personal data AG Advokat processes about you. We will, on your request or on our own initiative, correct or erase data that are incorrect or restrict our processing of your data. You have the right to request that we do not process your personal data for marketing purposes. You also have the right to access your personal data in a machine-readable format. Should you have any complaint on the way in which we process your personal data, please contact us or the supervisory authority, which in Sweden is the Data Protection Authority (www.datainspektionen.se). You can also contact the supervisory authority in the country where you work or reside.
